PART A – TERMS OF USE (Website & Online Services)
1. Definitions
- ‘Content’
– All information, graphics, products, features, services, and links
available on intexpress.com, including MyINT.
- ‘You’
/ ‘Your’ – The individual and/or entity accessing or using
intexpress.com or INT EXPRESS services.
- ‘INT
EXPRESS’ – INT Express Inc., its affiliates, subsidiaries, agents, and
contractors.
- ‘Shipment’
– All documents, parcels, or freight moving under one waybill.
2. Use of Site
- The
Site is provided solely for use by current and potential INT EXPRESS
customers to interact with INT EXPRESS.
- Permitted
uses include: preparing shipments, tracking, rating, accessing invoices,
making payments, and preparing documentation.
- Prohibited
uses include:
- Preparing
shipments on behalf of unauthorized third parties.
- Automated
scraping, bots, or dial-in tools.
- Submitting
unsolicited ideas or proposals (which INT EXPRESS may freely use without
obligation).
3. Registration & Account Security
- Users
registering for MyINT must provide
accurate information.
- You
are responsible for safeguarding login credentials.
- Notify
INT EXPRESS immediately of any unauthorized use.
- You
may only register in the country where your INT EXPRESS account is based.
4. Changes to the Site
INT EXPRESS may update, modify, or remove Content, tools, or
features at any time without notice.
5. Termination of Use
INT EXPRESS reserves the right to suspend or terminate your
Site access, with or without cause, at any time.
6. Ownership & Intellectual Property
- All
Content is protected by U.S. and international copyright, trademark, and
intellectual property laws.
- No
rights are transferred by your use of the Site.
- Copying,
reverse engineering, or creating derivative works is strictly prohibited.
7. Disclaimer of Warranty
- THE
SITE AND ALL CONTENT ARE PROVIDED ‘AS IS.’
- INT
EXPRESS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND
NON-INFRINGEMENT.
- INT
EXPRESS DOES NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION
OF THE SITE OR MYINT.
8. Limitation of Liability
- USE OF
THE SITE IS AT YOUR SOLE RISK.
- INT
EXPRESS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL, OR SPECIAL DAMAGES (INCLUDING LOST PROFITS, DATA, OR
BUSINESS INTERRUPTION), EVEN IF ADVISED OF SUCH DAMAGES.
9. Indemnity
You agree to indemnify and hold harmless INT EXPRESS, its
affiliates, officers, employees, and agents from any claims, damages, or
expenses arising from your use of the Site or violation of these Terms.
10. Privacy Policy
Your personal data is governed by the INT EXPRESS Privacy
Policy available at www.intexpress.com.
By using the Site, you consent to such collection and use.
11. Export Compliance
You are responsible for compliance with U.S. and
international trade laws.
- You
may not use INT EXPRESS services if you are on U.S. denied-party lists or
located in embargoed countries.
- Shipments
may not be used for the development or transport of nuclear, chemical, or
biological weapons.
12. Courtesy Rate Quotes
Rates shown online are estimates only. Actual charges
may differ based on weight, dimensions, service level, and applicable
surcharges.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of New
York, USA.
Disputes shall be brought exclusively in the state or federal courts located in
New York, NY.
14. Modifications
INT EXPRESS may update these Terms of Use at any time
without notice. Continued use of the Site constitutes acceptance of the updated
Terms.
PART B – TERMS AND CONDITIONS OF CARRIAGE
IMPORTANT NOTICE:
By tendering a Shipment to INT EXPRESS, the Shipper agrees that these Terms and
Conditions apply unless otherwise agreed in writing by an authorized officer of
INT EXPRESS.
1. Customs, Exports & Imports
INT EXPRESS may act on Shipper’s behalf for customs
clearance, including preparing documents, paying duties/taxes, appointing
customs brokers, or redirecting Shipments.
2. Unacceptable Shipments
Shipments are unacceptable if they:
- Contain
hazardous or prohibited items under IATA, ICAO, or U.S. law.
- Lack
required customs declarations.
- Include
restricted items (animals, bullion, currency, firearms, ammunition, human
remains, narcotics, pornography, etc.).
3. Deliveries & Undeliverable Shipments
- Delivery
is made to the Receiver’s address, not necessarily the named person.
- If
Receiver refuses, is unavailable, or Shipment is undeliverable, INT
EXPRESS may attempt return at Shipper’s cost. If unsuccessful, Shipment
may be disposed of without liability.
4. Inspection Rights
INT EXPRESS may open and inspect any Shipment without
notice.
5. Shipment Charges & Billing
- Charges
are based on the greater of actual or dimensional weight.
- INT
EXPRESS may re-weigh/re-measure any Shipment.
- Shipper
is liable for all charges, including duties, taxes, storage, and
surcharges.
- Overcharge
claims must be made within 1 year.
6. Liability of INT EXPRESS
- INT
EXPRESS liability is limited to USD $100 per Shipment unless
greater value protection is purchased.
- Liability
is for direct loss only; consequential damages (loss of profits, market,
income, or interest) are excluded.
- International
air shipments may be subject to Warsaw or Montreal Convention liability
limits.
7. Claims
- One
claim per Shipment only.
- International
claims must be filed within 30 days; U.S. domestic claims within 90
days.
- Original
packaging and contents must be retained for inspection.
- Claims
are processed only after all charges are paid.
8. Service Guarantee (Money-Back Guarantee)
- Refunds
or credits may be available for late deliveries, subject to restrictions.
- Guarantee
excludes: customs delays, weather, strikes, government actions,
undeliverable shipments, or circumstances beyond INT EXPRESS’s control.
- Claims
must be made within 15 calendar days of shipment date.
9. Shipment Value Protection
- Additional
coverage may be purchased by declaring value at booking and paying a
premium.
- Shipment
Value Protection excludes certain categories (cash, jewelry, art, live
animals, perishable cargo, personal goods, nuclear/radioactive materials,
fraudulent delivery, etc.).
10. Delayed Shipments
Delivery schedules are not guaranteed unless otherwise
agreed in writing. INT EXPRESS is not liable for damages caused by delays.
11. Circumstances Beyond Control
INT EXPRESS is not liable for loss or damage caused by
events outside its control, including natural disasters, war, strikes,
government actions, customs holds, or electronic data
corruption.
12. Shipper’s Warranties & Indemnities
The Shipper warrants that:
- Shipment
information is complete and accurate.
- Packaging
is secure and compliant.
- All
laws and regulations are followed.
- INT
EXPRESS is indemnified against loss from false declarations or violations.
13. Routing
INT EXPRESS may route or divert Shipments, including through
intermediate stops and alternate carriers.
14. Governing Law
These Terms of Carriage are governed by New York law
with exclusive jurisdiction in courts located in New York, NY.
15. Severability
If any provision is unenforceable, the remaining provisions
remain valid.
PART C – ACCEPTANCE OF TERMS
By arranging shipment pickups, deliveries, or logistics
services with INT EXPRESS—whether via email, phone, text message, or online
booking through MyINT—you acknowledge and accept
these Terms of Use and Terms of Carriage, including liability
limitations, billing obligations, and indemnification.
You are responsible for:
- Regularly
reviewing invoices via your MyINT
account.
- Ensuring
timely payment of all charges.
- Understanding
that non-payment may result in late fees, service interruption, or
recovery actions.
